Planning Permission
. The client presently wishes to proceed with a project for the fitting out of a retail unit
(hereinafter referred to as the Project).
b. The project requires the appointment of a planning supervisor pursuant to the Construction (Design and Management) Regulations 1994 as amended or the Construction (Design and Management) Regulations (NI) 1995 as amended (hereinafter referred to as the Regulations).
SHOPFITTERS c. The Client has requested the Planning Supervisor to act as planning supervisor for the Project.
Shop fittng planning permission
1.Except where otherwise stated, words and expressions used in this Agreement which are also used in the Regulations shall have the same meanings as in the Regulations and references to regulation numbers are to the Regulations.
2.Appointment
a.The Client hereby appoints the Planning Supervisor to discharge the requirements placed upon a planning supervisor by the Regulations (the Requirements).
b.The Planning Supervisor accepts the appointment as planning supervisor for the Project in accordance with this Agreement.
c.The appointment shall be deemed to have commenced on the date on which the Planning Supervisor commenced any work on or in connection with the Requirements or the Services notwithstanding that such work may have been carried out before the Planning Supervisors formal appointment , and shall continue , unless earlier terminated until delivery of the Health and Safety File to the Client within 4 weeks of practical completion of construction work
Streamline Provided always that information required for the Health and Safety File has been made available by designers and contractors. In the event that necessary information is not delivered to the Planning Supervisor, the work of the Planning Supervisor shall be deemed to have been completed in accordance with the above apply provided that the Planning Supervisor has delivered to the Client the otherwise completed Health and Safety File and notified the Client of the outstanding information.
dNo proceedings or action arising out of or in connection with the breach of this Agreement shall be brought against the Planning Supervisor after the expiry of 6 years from Practical Completion of the Works to which this Agreement relates.
eIf the Planning Supervisor receives any instruction from the Client under this Agreement which he considers to be inconsistent with the Requirements, or if the Client fails to comply with his duties under the Regulations, the Planning Supervisor shall immediately give the Client written notice of the same and the parties shall agree an appropriate course of action.
f The Client shall require the Principal Contractor, under the terms of the Principal Contractors contract:
i.To notify the Planning Supervisor immediately he becomes aware of anything which might affect the Health and Safety Plan as a result of site conditions encountered during progress of the works which may affect design matters including the design of temporary works, and/or development in or changes to the design of any part of the Project; and
ii.To discuss appropriate consequential amendments to the Health and Safety Plan with the Planning Supervisor; and
iii.Following and taking into account such discussions to make appropriate amendments to the Health and Safety Plan; and
iv.To provide all the information required for the health and Safety File reasonably within the constraints provided by the Planning Supervisor and any applicable programme and to provide 2 copies of that information.
3.Information
The client shall provide the following information to the Planning Supervisor as soon as is reasonably practicable but in any event before the commencement of the work which the information relates:
a)The information which the Client is obliged by the Regulations to provide to the Planning Supervisor; and
b)The information which the Planning Supervisor requests from the Client as being relevant to the Requirements and this Agreement; and
c)Any relevant information prepared by another planning supervisor previously appointed by the Client to carry out duties on or related to this Project.
